Terms of Use

The terms that apply when you use the BentoMind app and website.

These Terms of Use (“Terms”) govern your use of the BentoMind app for Android and the website at bentomind.shivanggupta.in (together, “BentoMind”). BentoMind is provided by Shivang Gupta (“we”, “us”).

1. Acceptance

By installing or using BentoMind you agree to these Terms and to our Privacy Policy. If you do not agree, do not use BentoMind. If you use BentoMind on behalf of an organisation, you confirm that you are authorised to accept these Terms for it.

2. The app

BentoMind is an AI assistant that runs open-weight language models on your Android phone. It can chat, transcribe your voice, and, if you allow it, use data on your phone (such as contacts, calendar, location and notifications) to answer your requests. Optional features connect to the internet, such as model downloads, web search, nearby places and remote models you configure. These are described in the Privacy Policy.

3. Licence to use

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use BentoMind on devices you own or control, for your personal or internal business purposes.

You may not: sell, rent or sublicense BentoMind; remove or alter notices of ownership or licences; use BentoMind to build a competing product by copying its non-open-source parts; or reverse engineer it, except where the law allows this despite this restriction. Open-source components included in BentoMind (such as llama.cpp) are licensed under their own licences, which take precedence for those components.

4. AI output

BentoMind generates text using AI models. AI output can be inaccurate, incomplete, outdated, biased or offensive, and small on-device models make mistakes more often than large cloud models.

  • AI output is not professional advice. Do not rely on it as medical, legal, financial, safety or other professional advice.
  • Verify important information independently before you act on it.
  • You are responsible for how you use AI output, including anything you share or publish.

If you see a harmful or offensive response, please tell us (see Contact) so we can improve the app.

5. Your responsibilities

You agree to use BentoMind lawfully and responsibly. In particular, you will not:

  • use BentoMind to break any law or to harm, harass, defraud or deceive anyone;
  • misuse other people’s personal data, for example data in your contacts, notifications or content shared with the app, or use BentoMind to access data you are not entitled to access;
  • generate or distribute content that is illegal, including content that exploits children;
  • try to bypass the app’s safety features or confirmation steps, or interfere with the services BentoMind connects to; or
  • use BentoMind in situations where an error could cause death, injury or serious damage.

You are responsible for your device, for the permissions you grant, and for any data charges from your mobile or internet provider (model files can be several gigabytes).

6. Third-party models and their licences

BentoMind does not include AI model weights. When you download a model, you download it from a third party (usually Hugging Face) under that model’s own licence. Examples include Apache-2.0, MIT, the Gemma Terms of Use, the Llama Community License and the LFM Open License. Some licences restrict commercial use or require you to accept an acceptable-use policy.

You are responsible for reviewing and complying with the licence of each model you download or add through a custom link. We do not make any promise about third-party models, their output or their licences.

7. Third-party services

Some features rely on services we do not control, including DuckDuckGo and Wikipedia (web search), the websites shown in search results, OpenStreetMap services (Nominatim and Overpass, for places), Hugging Face and GitHub (model downloads), Google’s on-device speech recognizer (if you choose it), and any remote model endpoint you configure. Your use of those services is subject to their own terms and privacy policies. They may change or stop working at any time, and we are not responsible for them.

If you connect a remote model, you are responsible for having the right to use that server and for any costs it charges. Messages you send to it, including any phone data a tool adds to the conversation, are handled by that server’s operator.

8. Confirmation of device actions

BentoMind asks you to approve (OK or Cancel) before it creates, changes or deletes data on your phone, such as contacts or calendar events. Please read each confirmation carefully. By tapping OK you authorise the action, and you are responsible for the result. Some actions, such as sending an SMS or placing a call, open another app where you complete the action yourself.

9. Early access, beta status and no warranty

BentoMind is in early access (beta). It may contain bugs, change significantly, or lose data, and features may be added or removed.

To the maximum extent permitted by law, BentoMind is provided “as is” and “as available”, without warranties of any kind, whether express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that BentoMind will be uninterrupted, error-free or compatible with your device. Running AI models can use significant battery, storage and processing power, and can make your phone warm.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising from or related to your use of BentoMind or its AI output, even if we were told such damages were possible.

To the extent we are liable despite the above, our total liability for all claims relating to BentoMind is limited to the greater of the amount you paid us for BentoMind in the 12 months before the claim, or INR 1,000.

Nothing in these Terms limits liability that cannot be limited by law, including your rights under applicable consumer-protection law.

11. Termination

You can stop using BentoMind at any time by uninstalling it. We may suspend or end your licence if you materially breach these Terms. Sections 4, 6, 7, 9, 10, 12 and 13 survive termination.

12. Governing law

These Terms are governed by the laws of India. Subject to any mandatory consumer-protection rights you have where you live, the courts of India have exclusive jurisdiction over any dispute arising from these Terms or BentoMind.

13. Changes to these Terms

We may update these Terms as BentoMind evolves. We will update the “Last updated” date above and, for significant changes, tell you in the app or on this website. If you continue to use BentoMind after changes take effect, you accept the updated Terms.
